Terms and Conditions

These Terms explain how Mountain Melodies works, what listeners may do with the music, how paid access is handled, and what we expect from every account holder. By creating an account, paying for access, streaming music, using the Android app, or using the website at mountainmelodies.co.ke or play.mountainmelodies.co.ke, you agree to these Terms.

1. Who we are

Mountain Melodies is a paid music streaming service focused on licensed music, artist releases, listener accounts, protected playback, and artist payout administration. In these Terms, "Mountain Melodies", "we", "us", and "our" refer to the Mountain Melodies service. "You" means the listener, artist, account holder, administrator, or other person using the service.

2. Accounts and sign in

Mountain Melodies uses a phone-number account flow. You must provide a phone number that you control and, where requested, an email address for receipts and account communication. You are responsible for keeping access to your phone, SIM card, email, and device secure.

You may not create accounts using another person's phone number, bypass verification, impersonate an artist or administrator, or use the service for fraud, scraping, resale, automated access, or rights abuse.

3. Paid access and subscriptions

Mountain Melodies is a paid listening service. Access is normally sold for a fixed listening period, such as 30 days, unless the checkout screen clearly says otherwise. A paid pass gives the registered account personal, non-transferable access to stream available music during the active access period.

Payments are processed through the method shown at checkout. On Android, where Google Play rules require Google Play Billing for digital content, Mountain Melodies will use Google Play Billing or another payment flow only where it is permitted by Google Play policy. Web payments, mobile money, card processors, or other payment providers may be used where permitted for the relevant platform and transaction.

Access starts after the payment is confirmed by the payment processor and recorded by Mountain Melodies. If money is deducted but access does not open, contact support with your registered phone number and payment reference. We may manually correct access after confirming the payment.

4. Renewals, cancellations, and refunds

Access is not guaranteed to renew automatically unless the checkout or billing provider clearly states that recurring billing is enabled. If a pass expires, you may be asked to reactivate or buy a new pass before listening again.

Refunds are reviewed case by case. We may approve a correction, refund, reversal, or access extension where a duplicate charge, payment mismatch, or technical payment error is confirmed. We may decline refunds where access was correctly provided, where a user changed their mind after streaming, where the request is unsupported by payment records, or where fraud or account abuse is suspected.

If payment was made through Google Play Billing, Google Play's refund and subscription management tools may also apply. If payment was made through mobile money, card, Paystack, bank, or another permitted processor, the relevant provider's settlement and reversal rules may affect timing.

5. Music rights and permitted use

All music, artwork, artist names, release information, lyrics, recordings, and related material remain owned by Mountain Melodies, the relevant artists, producers, labels, publishers, or other rights holders. Your paid access is a limited right to stream music inside the app or website for personal listening only.

You must not copy, download, record, rip, screen-record, redistribute, upload, sell, sublicense, broadcast, publicly perform, edit, sample, reverse engineer, bypass access controls, or share protected stream links. You must not use Mountain Melodies content in social media videos, advertisements, public events, radio, TV, political campaigns, commercial venues, or other public/commercial uses unless you have a separate written licence from the rights holder.

6. Playback protection and devices

Mountain Melodies uses protected playback sessions, device identifiers, session tokens, range requests, and heartbeat checks to keep streams secure, reduce account sharing, and support artist reporting. We may limit the number of active devices or sessions on an account, block suspicious playback, ask you to sign in again, or require a device reset through support.

Do not tamper with the app, native media bridge, web player, request headers, tokens, cookies, audio URLs, or device identity. Attempts to bypass access protection may lead to loss of access without refund.

7. Artist and administrator tools

Artists and authorized administrators may have access to tools for catalog setup, lyrics, tags, artist photos, payout profiles, earnings reports, bank details, listener support, and access correction. These tools must be used only for legitimate Mountain Melodies operations.

Artist payout information is operational and may depend on confirmed streams, payable minutes, payment settlement, rights splits, fraud checks, holds, bank verification, and manual approval. Any visible estimate is not a final payment promise until approved and paid.

8. User conduct

You must not use Mountain Melodies to harass others, upload illegal material, interfere with the service, attempt unauthorized admin access, submit false payment claims, attack the system, scrape catalog data, abuse support, or violate any law. We may suspend, restrict, or close accounts that create risk for listeners, artists, payment providers, or the service.

9. Availability and changes

We work to keep the app available and music playable, but streaming services can be affected by network issues, phone settings, device restrictions, payment delays, maintenance, app store review, content takedowns, licence changes, or provider outages. Some releases, tracks, tags, lyrics, artist pages, or features may be added, changed, paused, or removed.

10. Privacy and data

Our Privacy Policy explains what account, payment, device, playback, support, and artist data we collect and how we use it. It is part of these Terms. Read it at /privacy.

11. Account deletion

You can request account deletion from the Account area inside the app or from the public account deletion page at /account-deletion. Deletion is explained in more detail in the Privacy Policy and Account Deletion page.

12. Disclaimers and liability

Mountain Melodies is provided on an "as available" basis. We do not promise uninterrupted playback, availability of every track, compatibility with every device, or that every network condition will support streaming. To the maximum extent allowed by law, Mountain Melodies is not liable for indirect loss, lost profits, lost data, business interruption, unauthorized account use caused by your device or SIM security, or losses outside our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded.

13. Governing law and disputes

These Terms are intended to be governed by the laws of Kenya. Before taking formal action, you agree to contact support so we can review account, payment, playback, rights, or payout records and try to resolve the issue in good faith.

14. Changes to these Terms

We may update these Terms when the service, law, app store rules, payment flows, or music rights arrangements change. The updated version will be posted on this page with a new date. Continued use after an update means you accept the updated Terms.
